Welcome to Arizona Photobooth Express ("the Company," "we," "our," or "us"). By booking our services, you ("the Client," "you," or "your") agree to the following terms and conditions, which govern the provision of our Photobooth Express LLC rental services. Please read this agreement carefully, as it contains important information about your rights, responsibilities, and limitations.

1. Booking and Payment

1.1 Deposits: A non-refundable deposit is required at the time of booking to secure your event date. The deposit amount will be outlined in your booking confirmation.

1.2 Full Payment: The remaining balance is due no later than 48 hours before the event date. Failure to complete payment may result in cancellation of services without a refund of the deposit.

1.3 Accepted Payment Methods: Payments can be made via  credit card, PayPal, bank transfer

2. Cancellations and Refunds

2.1 Client Cancellations: If you cancel your booking:

• More than [number] days before the event: You may reschedule within [timeframe] at no additional cost, subject to availability.

• Less than [number] days before the event: No refunds will be issued.

2.2 Company Cancellations: In the unlikely event that we must cancel your booking due to unforeseen circumstances, we will provide a full refund of all payments made.

2.3 Force Majeure: Neither party shall be liable for failure to perform its obligations due to events beyond its control, such as natural disasters, pandemics, or government restrictions.

3. Event Requirements

3.1 Spatial Requirements: The Client must provide a flat, stable, and weather-appropriate space for the photobooth setup, as detailed in our spatial requirements policy. Inadequate space or unsafe conditions may result in refusal of setup without a refund.

3.2 Electrical Requirements: The Client must ensure access to a standard electrical outlet within [number] feet of the setup location. An extension cord will be provided if necessary.

3.3 Setup and Takedown: Setup and takedown times are included in the rental period. Additional time requested by the Client will incur an hourly fee.

3.4 Weather: For outdoor events, adequate shelter (e.g., canopy, tent) must be provided to protect the equipment. In extreme weather conditions, the Company reserves the right to cease operations to ensure safety and equipment protection.

4. Customizations and Deliverables

4.1 Photo Templates: Basic templates with minor customizations (e.g., name or event title) are included in most bundles. Advanced custom templates (e.g., logos, images) may incur additional fees. Clients must provide customization details at least [number] days before the event.

4.2 Digital Copies: Digital copies of event photos are available upon request for an additional fee. Delivery timelines will be discussed upon purchase.

4.3 Props and Backdrops: Clients may select props and backdrops from our inventory. Custom backdrops are available at an additional cost and require advance notice.

5. Liability

5.1 Damage to Equipment: The Client is responsible for any damage caused to the photobooth or related equipment due to negligence, misuse, or interference by guests.

5.2 Guest Conduct: The Client is responsible for ensuring that guests behave appropriately around the photobooth setup. The Company reserves the right to shut down operations if guest conduct endangers staff or equipment.

5.3 Liability Limitation: The Company is not liable for any injuries, property damage, or other incidents arising from the use of our photobooth services, except in cases of gross negligence or willful misconduct by our staff.

6. Privacy and Data Protection

6.1 Photo Usage: By using our services, you grant the Company the right to use photos taken at your event for promotional purposes, unless otherwise specified in writing before the event.

6.2 Data Security: The Company takes reasonable measures to protect the digital files and personal information collected. However, we are not liable for data breaches caused by third-party vendors or unforeseen circumstances.

6.3 Client Rights: Clients may request the removal of specific photos from our promotional materials at any time.

7. Dispute Resolution

7.1 Governing Law: This agreement shall be governed by the laws of the State of Arizona.

7.2 Resolution Process: Any disputes arising from this agreement will first be attempted to resolve through informal negotiation. If unresolved, disputes shall be settled through binding arbitration in [City, State].

8. Miscellaneous

8.1 Amendments: The Company reserves the right to amend these terms and conditions at any time. Clients will be notified of significant changes.

8.2 Entire Agreement: This agreement constitutes the entire understanding between the Client and the Company and supersedes all prior agreements or understandings.

8.3 Severability: If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
